Terms and Conditions
1. Definitions
• “Kayak Away”, “we”, “us” refers to the equipment rental provider.
• “Customer”, “you” refers to the individual making the booking.
• “Equipment” refers to kayaks, paddles, buoyancy aids, and any accessories provided.
2. Nature of Service
• Kayak Away provides kayak and equipment rental only.
• We do not organise guided trips, events, routes, or water activities.
• All use of equipment is independent and at the customer’s own discretion.
3. Booking & Payment
• All bookings must be made using accurate and complete information.
• A booking confirmation confirms the type and quantity of equipment rented.
• Full payment or agreed deposit is required prior to collection unless otherwise agreed.
• If online payment is not completed within 20 minutes, the booking may be automatically cancelled and the selected date may be released back to availability.
4. Equipment Collection & Return
• All equipment must be collected and returned at the agreed time and location.
• The customer is responsible for checking the equipment at the time of collection.
• All equipment will be inspected again upon return.
• Any loss, damage, or excessive wear may result in additional charges.
• Failure to return equipment may result in full replacement charges.
5. Equipment Condition & Safety Checks
• All equipment is inspected, tested, and prepared before each rental to ensure it is in proper working condition.
• Kayak Away maintains appropriate public liability insurance in relation to its rental activities.
• By accepting the equipment, the customer confirms that it has been received in good condition unless stated otherwise at the point of collection.
6. Use of Equipment
• The customer agrees to use all equipment responsibly and only for its intended purpose.
• The customer must follow basic safety practices and ensure all participants use the equipment appropriately.
• The equipment must not be misused, modified, or used in unsafe conditions.
7. Licences and Waterway Access
• Kayak Away does not provide or include any waterway licences as part of the rental.
• It is the sole responsibility of the customer to ensure that they hold a valid licence where required for the waterway they intend to use.
• Information regarding routes and licence requirements may be found on our website, including the “Roads” and “Licences” sections, and through recommended third-party resources.
• Kayak Away does not guarantee the accuracy of this information and accepts no responsibility for failure to obtain the appropriate licence.
• We may provide guidance or assistance upon request or at the time of collection; however, responsibility remains with the customer.
8. Booking Responsibility & Group Hire
• The individual making the booking is fully responsible for:
• all equipment rented under their name
• all participants included in the booking
• any loss, damage, or misuse of equipment
• For group bookings, only the lead customer’s details are required.
• That individual accepts full responsibility on behalf of the entire group.
• All participants are considered to be under the responsibility of the lead customer.
9. Rental Agreement
• A short-form rental agreement must be reviewed and signed at the time of equipment collection.
• This agreement confirms:
• acceptance of these Terms & Conditions
• responsibility for the equipment
• the quantity of equipment rented
• The booking confirmation and signed agreement together form the full rental contract.
10. Personal Data & Privacy
• Kayak Away collects basic personal data, such as name, contact details, and date of birth, for the purpose of bookings and rental agreements.
• All personal data is processed in accordance with applicable data protection laws, including the UK GDPR.

• Kayak Away is registered for data protection purposes.
11. Environmental Responsibility
• Customers are expected to respect the environment at all times.
• Littering or damage to natural surroundings is strictly prohibited.
12. Liability
• All equipment is used at your own risk.
• Kayak Away is not liable for any injury, loss, or damage arising from the use of the equipment, except where such liability cannot be excluded under UK law.
13. Damage, Loss & Additional Charges
• The customer is financially responsible for any loss, theft, or damage to the equipment during the rental period.
• Charges will apply for:
• damaged equipment
• lost items, including paddles or accessories
• equipment returned in an unusable condition
• Costs will be assessed based on repair or replacement value.
